4. Sales Priceses Prices

The prices are subject to change, however, they will not be applied to orders that have already been confirmed with an order confirmation email.

4.3

On our website, a large number of products are sold, and it is always possible that, despite our efforts, some of the products listed on the site may have an incorrect price indication. Normally, we verify the price during our shipping process, so if the actual price of a product is lower than the one indicated by us, we will refund the amount you paid during the shipping process. 5.  Payment Methods

5.1

Payment can be made through PayPal account, VISA, MASTERCARD, VISA ELECTRON, POSTEPAY credit cards accepted during the order completion process, or via bank transfer. The bank details will be provided in the order confirmation email. We will confirm the amount to be paid in the electronic purchase confirmation message. In all cases, your communication of the credit card number and the final validation of the order will constitute proof of the integrity of the said order in accordance with the provisions of Legislative Decree no. 70/2003 and will be valid for the collection of the amounts paid.

All credit card payments are subject to a validity check carried out by the card issuer, who must also authorize its use. The order will be deemed effective only after the banking payment centers have confirmed it. The personal data of the credit card holder necessary for the aforementioned checks may therefore be shared with third parties. We decline any responsibility for delays or non-delivery of your order in the event that the credit card issuer does not authorize the payment.

5.3

We would like to inform you that the shipment will not be made until we have received full payment from you. Therefore, we reserve the right to postpone the shipping date until we have received full payment for the ordered products. Additionally, we reserve the right to cancel the order and provide you with immediate written notice if you fail to make the payment within the specified timeframe without valid reason.

6.  Delivery

6.1

Franco Cuomo gioielli offers a standard delivery service. The delivery times are 2-5 working days from the receipt of the Shipping Confirmation email, unless otherwise specified and communicated to you, and in any case, not exceeding 30 days from the conclusion of the contract. In any case, upon acceptance of your purchase, you will receive a shipping notification via email to the email address you provided during the ordering process.

6.2

The delivery address will correspond to the information you provided and that we have confirmed in the purchase confirmation email. In the event of non-delivery, we will leave a delivery notice, and it will be your responsibility to pick up the package at the designated location within the specified timeframe. If the package is not picked up within the specified timeframe, the products will be returned to Franco Cuomo gioielli, and it will be your responsibility to contact Customer Service for a possible reshipment at your own expense.

6.3

If we are unable to meet the specified delivery deadline stated in the order shipment confirmation email, without any default on your part (such as non-payment), we will immediately contact you to communicate the new delivery date. However, if the delivery does not take place within 30 days from the date of contract conclusion, you have the right to request us to deliver the goods within a reasonable additional timeframe, taking into account the circumstances. If the additional timeframe you propose for the delivery of the goods elapses without the delivery taking place, you have the right to cancel the order by sending us a registered letter with acknowledgment of receipt or an email to info@francocuomogioielli.it, in accordance with Article 61 of Legislative Decree 206/2005. In this case, the purchase price of the corresponding product, which may have been charged to you, will be refunded without undue delay from the receipt of our notification of order cancellation, using the same means of payment you used for the initial transaction.

7.  Transfer of Risk and Ownership

7.1

The product becomes your property upon full payment of the purchase price. However, please note that we reserve the right to reclaim the product at any time until ownership of the product has been transferred to you, particularly in cases where you are in breach of the contract.

7.2

The transfer of risks occurs at the time of delivery, except as provided in Article 63(2) of Legislative Decree No. 206/2005. The risks, according to this provision, are those related to the loss or damage of the product caused by its use, alteration, or storage. The risks associated with the return of a product, for any reason, are your responsibility.

8.  Information regarding the exercise of the right of withdrawal - pursuant to Article 49, paragraph 4, of the Consumer Code and Complaints

8.1

You have the obligation to immediately notify us of any partial delivery of the ordered products, as well as the receipt of defective or damaged products. Any complaints and issues (delivery errors, discrepancies, etc.) should be communicated to our Customer Service at the email address: info@francocuomogioielli.it

8.2

We hereby inform you that you have the right to withdraw from the sales contract, without stating the reasons, within 14 days from when you or a third party, other than the carrier and designated by you, have physically acquired the possession of the goods. To comply with the withdrawal period, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period. Please note that in accordance with Article 59 of Legislative Decree September 6, 2005, No. 206 (Consumer Code), the right of withdrawal is excluded for the supply of sealed goods (such as earrings) that are not suitable to be returned for hygienic reasons or reasons related to health protection and have been opened after delivery. To exercise the right of withdrawal, you are required to inform us of your decision to withdraw from the sales contract. For this purpose, you can complete and electronically send or mail the standard withdrawal form available here or any other explicit statement to the following address info@francocuomogioielli.it, returning the product to the address specified in point 7.4, accompanied by the Delivery Note and the Return Form that you will find on the Website - Delivery and Returns section. We will promptly send you a confirmation of receipt of the withdrawal by email.

8.3

Effects of withdrawal. If you exercise the right of withdrawal, you will be reimbursed for all payments made to us, excluding any shipping costs, without undue delay and in any case no later than 14 days from the day we were informed of your decision to withdraw from the sales contract. Such refunds will be made using the same means of payment you used for the initial transaction, without any charges or costs incurred as a result of the refund. The refund may be withheld until the goods are received or until you have provided evidence of having returned the goods, whichever is earlier.

8.4

8.5

We are only responsible for the decrease in the value of the goods resulting from handling the goods in a manner other than what is necessary to establish the nature, characteristics, and functioning of the goods. Therefore, Franco Cuomo Gioielli reserves the right to verify the condition of the returned goods and to communicate to you, at the email address provided at the time of purchase, any reduction in the value of the returned goods attributable to you, due to handling exceeding what is described in the preceding paragraph.

8.6

The right of withdrawal is exclusively reserved for individuals (consumers) and cannot be exercised by legal entities or individuals acting for purposes related to their professional activities, if any.

9.  Warranty

9.1

We always strive to ensure that the watches you choose are in optimal condition. In any case, our watches are accompanied by both the International Manufacturer's Warranty and the legal warranty of conformity.

9.2

International Manufacturer's Warranty: All watches offered for sale on this website benefit from a 24-month International Manufacturer's Warranty, unless otherwise specified. The International Warranty may have a longer validity when expressly stated. The international warranty covers any defects in the materials used and any manufacturing defects present at the time the watch was sold. The warranty is valid and recognized only upon presentation of the warranty certificate found inside the packaging. The general conditions regarding the warranty are stated on the warranty certificate provided with each watch.

9.3

Legal Warranty of Conformity: In accordance with the provisions of the Civil Code and the Consumer Code, all products offered for sale on this website are covered by the legal warranty of conformity, which includes the following:

Consumer Rights (Article 130 of the Consumer Code):

  1. The seller is responsible towards the consumer for any lack of conformity existing at the time of delivery of the goods.

  2. In the event of a lack of conformity, the consumer has the right to have the goods restored to conformity, free of charge, through repair or replacement, in accordance with paragraphs 3, 4, 5, and 6, or to an appropriate price reduction or contract termination, in accordance with paragraphs 7, 8, 9.

  5. Repairs or replacements must be carried out within a reasonable period of time from the request and must not cause significant inconvenience to the consumer, taking into account the nature of the goods and the purpose for which the consumer purchased the goods.

  6. The costs referred to in paragraphs 2 and 3 relate to the necessary expenses incurred to bring the goods into conformity, particularly with regard to shipping costs, labor, and materials.

  7. The consumer may choose, at his/her discretion, an appropriate price reduction or contract termination if any of the following situations occur: a) repair or replacement is impossible or excessively burdensome; b) the seller has not carried out the repair or replacement of the goods within the reasonable period referred to in paragraph 5; c) the replacement or repair previously carried out has caused significant inconvenience to the consumer.

  8. In determining the amount of the reduction or the amount to be refunded, the use of the goods is taken into account.

  9. After reporting the lack of conformity, the seller may offer the consumer any other available remedy, with the following effects:

        a) If the consumer has already requested a specific remedy, the seller remains obliged to implement it, with the necessary consequences regarding the starting point of the reasonable period referred  to in paragraph 5, unless the consumer accepts the proposed alternative remedy;

b) If the consumer has not yet requested a specific remedy, the consumer must accept the proposal or reject it by choosing another remedy in accordance with this article.

  1. A minor lack of conformity for which it was not possible or excessively burdensome to carry out the remedies of repair or replacement does not entitle the consumer to contract termination.

Time Limits (Article 132 of the Consumer Code):

  1. The seller is responsible, in accordance with Article 130, when the lack of conformity manifests within two years from the delivery of the goods.

  2. The consumer loses the rights provided for in Article 130, paragraph 2, if he/she does not report the lack of conformity to the seller within two months from the date on which he/she discovered it. The report is not necessary if the seller has acknowledged the existence of the defect or concealed it.

  3. Unless proven otherwise, it is presumed that the lack of conformity that manifests within six months from the delivery of the goods already existed at that date, unless this assumption is incompatible with the nature of the goods or the nature of the lack of conformity.

  4. The action to assert defects not fraudulently concealed by the seller is time-barred, in any case, within twenty-six months from the delivery of the goods. However, the consumer who is a party to the contract can always assert the rights provided for in Article 130, paragraph 2, provided that the lack of conformity has been reported within two months from the discovery and before the expiration of the period referred to in the preceding paragraph.

Civil insurrections, riots, invasions, terrorist attacks or threats of terrorist attacks, wars (declared or undeclared), or the threat or preparation of wars.

15.5.3

Fires, explosions, hurricanes, floods, earthquakes, collapses, epidemics, or other natural disasters.

15.5.4

Inability to use railways, ships, aircraft, wheeled transport, or other public or private means of transportation.

15.5.5

Inability to use public or private communication networks.

15.6

Our performance under this contract shall be considered suspended during the period in which such events beyond our control are ongoing, and we shall be granted an extension of time for each of our ongoing obligations during the duration of such events. Nonetheless, we shall exercise reasonable diligence to ensure that the event concludes or to find a solution that enables us to fulfill our obligations despite the event.

Waivers: If, during the duration of the contract, we fail to insist upon the fulfillment of your obligations or fail to exercise rights or remedies to which we are entitled under the contract, it shall not be deemed as a waiver of such rights or remedies, and it shall not relieve you from the obligations set forth in this contract. Our waiver in response to your non-compliance shall not be considered a waiver in subsequent instances of your non-compliance. No waiver by us of any of these terms of sale shall be effective unless expressly stated and communicated to you in writing in accordance with the provisions set forth in the preceding paragraph 14.4.

Unicity of Agreement: These general terms and conditions of sale, along with any documents expressly referred to herein, constitute the sole valid agreement between us and supersede any other agreement, whether written or oral, that has been previously made. It is understood that by signing this contract, neither party has relied on any promises or obligations from the other party, nor any other obligations arising from oral or written agreements prior to this contract, unless expressly stated in these terms of sale. Neither party shall have any remedies in relation to false statements made by the other party, whether in writing or orally, prior to the date of the agreement (unless such false statements were made fraudulently), and the sole remedy available to the other party shall be for breach of contract as provided in these terms of sale.

16. Applicable Law and Competent Court

16.1

These terms and conditions of sale and delivery are governed by Italian law. The competent court will be the Italian court territorially competent according to Italian law.
